The US ITC formally launched a 337 investigation on LED lighting equipment
On August 15, 2023, the U.S. International Trade Commission (ITC) voted to launch a 337 investigation (investigation code: 337-TA-1371) on specific LED lighting equipment, LED power supplies and their components and downstream products.
It is reported that on July 14, 2023, Signify North America Corporation, of Bridgewater, New Jersey, and Signify Holding B.V., of the Netherlands filed a Section 337 investigation application with the U.S. ITC, advocating exports to the United States, imports in the United States, and sales in the United States. This product infringes its intellectual property rights (US registered patent numbers 8,063,577, 9,119,268, 8,070,328), and requests the US ITC to issue a limited exclusion order and prohibition order. Current Lighting Solutions, LLC, of Beachwood, Ohio, USA is the named defendant.
Information shows that Section 337 investigation refers to the U.S. International Trade Commission’s practice of investigating unfair import practices and taking sanctions based on Section 337 of the U.S. Tariff Act of 1930 (referred to as “Section 337”). If an imported product infringes upon valid intellectual property rights in the United States, the intellectual property right holder (whether it is a U.S. or foreign enterprise) can file a Section 337 investigation application with the ITC and request the ITC to take relevant relief measures.
